Welcome to POPUP BIRDIE! These Terms of Service (“Terms”) outline the terms and conditions for renting and using our mobile golf simulator services. By booking or using our services, you agree to be bound by these Terms.

1. Service Overview

PopUp Birdie is Northern Colorado’s first premier mobile golf simulator rental company. We provide mobile golf simulator rentals, including equipment setup, on-site support, teardown, and related services (“Services”) for events such as weddings, graduations, birthdays, private parties, backyard gatherings, corporate events, team building, client entertainment, brand activations, charity events, and fundraisers. Our Services are available for rent throughout Northern Colorado and the surrounding area.

Our simulator is powered by GSPro software and features 500+ courses, 4 game modes, 6+ mini games, and 15+ data points on ball and club performance.

2. Packages, Add-Ons, and Pricing

2.1 Packages

  • Par Package — $500, 2 hours. Includes set up and tear down, onsite caddie, standard set of right-hand clubs, real-time stats, premium hitting mat, and standard range and par 3 courses. Best for small get-togethers, kid parties, and private lessons.
  • Birdie Package — $900, 4 hours. Includes everything in the Par Package plus full mobile golf simulator setup, TV display for spectators, full access to all 500+ courses, competition play, and unique challenges and game modes.
  • Eagle Package — Custom pricing for corporate events. Includes everything in the Birdie Package plus onsite caddie, AI putting game mat, multi-day availability, a standard set of right-hand clubs, and women’s and kids’ clubs. Best for corporate events, large parties, weddings, and brand activations.

2.2 Add-Ons

  • AI Putting Mat: $150 one-time rental fee for Par or Birdie packages (included in Eagle/Corporate packages). Includes 100+ digital games, challenges, detailed stats, and iPad display.
  • Additional Time: $200 per additional hour.
  • Additional Clubs: $100 per set. Available sets include women’s right-hand clubs, kids’ clubs, and men’s left-hand clubs.

2.3 Booking Confirmation

  • To secure a booking, a completed booking form and payment deposit are required. Bookings are confirmed upon receipt of payment and a signed rental agreement.

2.4 Payment Terms

  • We require a deposit of 50% of the total rental fee to confirm your reservation. The remaining balance is due the day of the event. For last-minute bookings, full payment will be required upon confirmation.

2.5 Cancellation Policy

  • Cancellations made one (1) week or more before the scheduled event will qualify for a full refund of deposit.
  • Cancellations must be made at least 48 hours before the event to qualify for a 50% refund of deposit.
  • Cancellations made within 48 hours of the event are non-refundable.

3. Customer Responsibilities

3.1 Space Requirements

  • The customer is responsible for providing a suitable space for the simulator setup, approximately 16ft x 20ft x 11ft (H) with access to a standard power source. The simulator can be set up indoors or outdoors provided the space meets these requirements and weather conditions are appropriate for outdoor use.

3.2 Equipment and Clubs

  • PopUp Birdie provides all clubs and equipment needed to use the simulator. Guests are welcome to bring their own clubs if they prefer.

3.3 Safety and Supervision

  • The customer is responsible for ensuring a safe environment for guests using the simulator. Children under the age of 13 must be supervised while using the equipment.

3.4 Loss or Damage

  • Any damage to equipment caused by customer negligence or misuse may result in additional charges for repair or replacement. The customer agrees to take reasonable care of all equipment provided by PopUp Birdie.

4. PopUp Birdie’s Responsibilities

4.1 Setup and Takedown

  • Our team will handle all aspects of simulator setup before the event and takedown afterward. We aim to complete setup within 90 minutes and takedown within 45 minutes, ensuring minimal disruption to the event.

4.2 On-Site Support

  • During the event, our staff will be available to provide assistance and technical support. We aim to ensure a smooth and enjoyable experience for all guests.

4.3 Equipment Maintenance

  • PopUp Birdie will maintain the simulator and other equipment in good working order. Should any technical issues arise, we will make reasonable efforts to resolve them promptly.

5. Limitation of Liability

To the extent permitted by law, PopUp Birdie is not liable for any injuries, damages, or losses arising from the use of our services or equipment. The customer assumes all risks related to the use of the simulator, including but not limited to risks associated with physical activity and simulator operation.

6. Intellectual Property

All content provided by PopUp Birdie, including logos, images, text, and software (e.g., GSPro software), is protected by intellectual property laws and is for use solely in connection with our services. Any unauthorized use or reproduction of our content is prohibited.

7. Privacy

PopUp Birdie respects the privacy of all customers. We collect and store personal information only for booking purposes and to improve our services. We do not share personal information with third parties unless required by law.

8. Governing Law

These Terms of Service are governed by the laws of the State of Colorado. Any disputes arising under or relating to these Terms will be resolved in the courts of Colorado.

9. Changes to Terms of Service

PopUp Birdie reserves the right to update or modify these Terms at any time. Any changes will be posted on our website, and continued use of our services following such updates signifies acceptance of the revised Terms.
